1. Overview

These Terms of Use (“Terms”) govern your access to and use of the Borrow Money & Loans – BigCash mobile application, website, and any related features or services (collectively, the “App”), which is operated by Big Cash For UL LLC (“we,” “us,” or “our”). By accessing, downloading, or using the App, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not access or use the App.

The App is a financial services platform that allows users to explore potential cash advance or loan opportunities offered by independent third-party lenders or financial partners. Big Cash For UL LLC does not provide loans or cash advances directly and is not a lender. All credit decisions, approval determinations, loan terms, interest rates, fees, and contractual obligations are made solely by third-party providers.

2. Eligibility

To access or use the App, you must meet all of the following requirements:

• Be at least eighteen (18) years of age, or the age of majority in your state of residence
• Be a lawful resident of the United States
• Have the legal capacity to enter into binding contracts
• Provide accurate, complete, and current information
• Use the App solely for personal, lawful, and non-commercial purposes

You are responsible for maintaining the confidentiality of your account credentials and for all activity conducted under your account. You must notify us immediately if you believe your account has been accessed or used without authorization.

3. Loan Terms, APR, and Repayment

3.1 APR Range

Annual Percentage Rate (“APR”) represents the annualized cost of borrowing and may include interest and applicable fees. Loan or cash-advance offers presented through the App may carry APRs of up to 35%, depending on factors including, but not limited to:

• Your credit profile and credit history
• The loan or advance amount requested
• The selected repayment term
• Individual lender underwriting criteria
• Applicable federal and state laws and regulations

All applicable APRs, fees, and total repayment amounts are clearly disclosed before you accept any offer.

3.2 Repayment Terms

Repayment terms vary by lender and product type. Typical repayment periods range from 3 to 24 months. Prior to acceptance, you will receive a detailed repayment schedule that outlines:

• The total number of payments
• The amount of each payment
• Payment due dates

3.3 Payment Methods

Payments are typically made through electronic fund transfers, including ACH debits from your designated bank account. Certain lenders may offer alternative payment methods. You are responsible for maintaining sufficient funds to avoid late fees, returned payment charges, or other penalties imposed by the lender.

3.4 Fees and Charges

Any applicable fees, including origination fees, late fees, returned-payment fees, or expedited processing charges, are fully disclosed before you accept an offer. The App does not impose hidden fees.

3.5 Early Repayment

Some lenders permit early repayment without penalty, which may reduce the total cost of borrowing. Early payoff terms vary by lender and are governed by the individual loan agreement.

4. Account Responsibilities

You agree to provide truthful, accurate, and complete information and to keep such information current while using the App. You may not:

• Submit false, misleading, or incomplete information
• Share or allow others to access your account credentials
• Access or attempt to access another individual’s account
• Engage in fraudulent, deceptive, or unlawful activity

We reserve the right to suspend or terminate accounts that violate these Terms or present security, fraud, or compliance risks.

5. Electronic Communications

By using the App, you consent to receive communications electronically, including but not limited to:

• Email notifications
• SMS or text messages
• In-app alerts and messages
• Electronic agreements, disclosures, and notices

Electronic communications have the same legal effect as written documents. Certain communications may be required by law and cannot be opted out of.

6. Data Accuracy and Authorization

By submitting information through the App, you authorize Big Cash For UL LLC to:

• Collect, process, and store your personal and financial information
• Share relevant information with participating lenders and service providers
• Use third-party services to verify identity, income, employment, or bank account details

Providing inaccurate, incomplete, or misleading information may result in denial of requests, suspension or termination of your account, or other legal consequences.

7. Fees and Compensation

The App is provided to users at no cost. Big Cash For UL LLC may receive referral fees or marketing compensation from third-party lenders or partners when users are connected to financial products through the App. Such compensation does not influence loan approval decisions or the terms offered by lenders.

8. Permitted and Prohibited Use

You agree to use the App in compliance with all applicable laws and regulations. Prohibited activities include, but are not limited to:

• Violating local, state, or federal laws
• Attempting unauthorized access to systems, accounts, or data
• Using automated tools, bots, or scripts to extract data
• Uploading malware, viruses, or harmful code
• Copying, reverse engineering, modifying, or distributing the App
• Sending unsolicited or unauthorized communications

Violations may result in account termination and potential legal action.

9. Service Modifications

We may update, modify, suspend, or discontinue any portion of the App at any time without prior notice. Temporary interruptions may occur due to maintenance or system updates. Big Cash For UL LLC is not responsible for service interruptions or changes.

10. Intellectual Property

All content within the App, including software, text, graphics, logos, trademarks, and data, is owned by Big Cash For UL LLC or its licensors. Users are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes. Unauthorized reproduction, distribution, or commercial use is prohibited.

11. Disclaimers

The App and its content are provided on an “as is” and “as available” basis. Big Cash For UL LLC makes no warranties regarding accuracy, reliability, availability, or suitability. All express and implied warranties, including warranties of merchantability, fitness for a particular purpose, and non-infringement, are disclaimed to the fullest extent permitted by law.

12. Limitation of Liability

To the maximum extent permitted by law, Big Cash For UL LLC shall not be liable for:

• Indirect, incidental, special, or consequential damages
• Loss of profits, data, or other intangible losses

Our total liability to any user shall not exceed $100. Certain jurisdictions may not permit such limitations, in which case applicable law will govern.

13. Indemnification

You agree to indemnify, defend, and hold harmless Big Cash For UL LLC, its officers, employees, affiliates, and partners from any claims, damages, losses, or expenses arising out of:

• Your use or misuse of the App
• Your violation of these Terms
• Your violation of applicable laws or third-party rights

14. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-law principles. Any dispute shall be resolved through binding individual arbitration under the Federal Arbitration Act. Class actions and representative proceedings are not permitted. If arbitration is not available, disputes shall be resolved in state or federal courts located in Delaware.

15. Termination

We may suspend or terminate your access to the App at any time for violations of these Terms, suspected fraud, or conduct that poses risk or harm. You may stop using the App by uninstalling it and, where applicable, closing your account. Sections related to liability, indemnification, and dispute resolution survive termination.

16. Changes to Terms

We may revise these Terms periodically. The Effective Date will be updated accordingly, and material changes may be communicated through the App or by email. Continued use of the App after changes constitutes acceptance of the revised Terms.
